WORK AUTHORIZATION & TERMS AND CONDITIONS

By accepting the attached Clover estimate, customer acknowledges and agrees to the following Work Authorization & Terms and
Conditions and authorizes Texas Gulf Marina to perform the requested work, diagnostics, vessel movement, sea trial testing, and
related services described in the estimate and/or discussed with Texas Gulf Marina.

WORK AUTHORIZATION

1.  Estimate Only: Customer understands that any estimate provided is an estimate only and is not a guaranteed final price. Final
charges may increase or decrease based upon actual labor, materials, hidden damage, unforeseen conditions, additional requested
work, or repairs required after disassembly or inspection.
2.  Vessel Movement & Testing: Texas Gulf Marina is authorized to operate, move, inspect, dock, launch, haul, transport, or sea trial
the vessel as reasonably necessary for inspection, diagnostics, repair verification, docking, storage, or related marina operations.
3.  Diagnostics & Disassembly: Customer authorizes Texas Gulf Marina staff to perform diagnostics and disassembly procedures
reasonably necessary to determine repair requirements.
4.  Additional Work: Texas Gulf Marina will make reasonable efforts to contact customer for approval before performing additional
work substantially exceeding the original estimate; however, customer acknowledges that delays in communication may affect repair
schedules, storage availability, launch schedules, or vessel safety.
5.  Removed Parts: All parts removed from the vessel will be discarded unless customer requests their return before work begins.
6.  Charges: Customer agrees to pay for all authorized labor, parts, materials, storage, haul-outs, subcontracted services,
environmental fees, and applicable taxes. Current labor rate is $120.00 per hour unless otherwise stated in writing.

ESTIMATE / INVOICE TERMS & CONDITIONS

1.  Nature of Estimate: This estimate is based on visible and reported conditions only. Final charges will reflect actual labor,
materials, and time required to complete the requested work.
2.  Labor Rate: Standard labor is billed at the current posted labor rate unless otherwise stated in writing.
3.  Authorization for Additional Work: Additional work exceeding the approved estimate amount may require customer
authorization via text, email, phone, or other written correspondence when practical.
4.  Parts & Materials: Prices for parts, paint, fiberglass materials, fuel, and supplies are subject to supplier pricing and availability and
may fluctuate.
5.  Storage & Delay: Vessels left beyond seven (7) days after job completion or notification of completion may be subject to daily
storage fees. A late payment fee of $50.00 will be assessed after seven (7) days past due. Any unpaid balance remaining after thirty
(30) days from invoice date will incur a finance charge of 1.5% per month, which shall continue to accrue every thirty (30) days
thereafter until paid in full.
6.  Lien for Nonpayment: Texas Gulf Marina retains a possessory lien on any vessel, motor, trailer, or equipment for unpaid labor,
materials, storage, dockage, or related charges pursuant to Texas Property Code § 70.001 et seq.
7.  Abandoned Property: Vessels unclaimed for more than sixty (60) days after completion and notice may be considered
abandoned and subject to disposal or sale pursuant to applicable Texas law.
8.  Warranty: Unless otherwise stated in writing, labor is warranted for thirty (30) days from completion. Manufacturer warranties
apply to parts and materials only.
9.  Liability: Texas Gulf Marina shall not be responsible for loss or damage caused by fire, theft, storms, flooding, vandalism, acts of
God, marina traffic, equipment failure, or other causes beyond reasonable control.
10.  Payment Terms: Payment is due upon completion unless otherwise agreed in writing. Past due balances may incur late fees,
finance charges of 3.5% per month, collection costs, attorney fees, and storage fees as permitted by law.
11.  Credit & Debit Card Payments: Texas Gulf Marina reserves the right to assess a 1.5% processing fee on any invoice balance of
$2,500.00 or greater when paid by credit card or debit card.                                                                                                                                                                                                  12.  Acceptance of Terms: Acceptance of the Clover estimate constitutes acknowledgment and acceptance of these Work Authorization & Terms and Conditions.
